If parents cannot come to an agreement between themselves, it may be time to turn to a trusted child arrangement solicitor to help create a Child Arrangement Order.
When a relationship breaks down it is tough on the parents, but the hidden victims can be the children. Great care must be taken to minimise the effects upon them. Other family members can also find their relationship with the children badly affected, as links are untied and separation occurs.
Our specialist family lawyers, including a Resolution Accredited specialist in private children matters, will provide you with guidance, support and advice for your individual circumstances whilst prioritising the wellbeing of your children. It is hoped that parents will make arrangements between themselves as to the time the child spends with each parent. However, if all else fails, Child Arrangements Orders can be made to specify the practical arrangements for a child in seeing or living with each parent. The Court however expect that parents will attend a Mediation Information and Assessment Meeting, often referred to as a MIAM, in advance of considering Court proceedings to attempt to resolve these issues (unless this is inappropriate). We have links with local mediation services to assist with this process.
We assist with:
- Negotiating arrangements out of court
- Supporting you through the Mediation process
- Child arrangement court applications (“live with” and “spend time” with orders together with specific issue and prohibited steps orders)
- Obtaining and advising about parental responsibility
- Schooling and relocation issues
These services are charged at an hourly rate (unless you are eligible for legal aid) however prior to instructing us on an hourly rate basis, you could take advantage of our one hour fixed fee meeting which will provide you with general initial advice regarding the issues above that may be relevant to you if you are thinking about ending your relationship or have already decided to progress matters. Our fixed fee appointment cost £180 including VAT.
You may be entitled to Legal Aid to help cover legal costs if you are a victim of domestic abuse or there are safeguarding concerns in respect of the other party’s risk or care to a child/children. Our team can assess your eligibility and assist with the application process.
